Terms of Service

Last updated: April 22, 2026. By using opsmed.net or booking OpsMed courier services, you agree to these Terms.

1. Acceptance of Terms

By accessing this website or booking a delivery with OpsMed, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the website or our services.

2. Services

OpsMed provides on-demand and scheduled medical courier services to healthcare providers in Southeastern Virginia, including same-day and STAT delivery, recurring routes, and compliance-aware handling. Service availability and pricing may change without notice.

3. Eligibility

OpsMed services are intended for businesses and licensed healthcare providers. You represent that you have authority to request the delivery and that the items you tender are lawful to transport.

4. Prohibited items

OpsMed does not transport:

  • Controlled substances, narcotics, or items requiring DEA chain-of-custody beyond our authorized scope.
  • Hazardous materials outside trained categories (e.g., explosives, radioactive material).
  • Cash, jewelry, weapons, or items prohibited by law.
  • Live animals or human organs unless explicitly contracted.

Tendering prohibited items may result in refusal, return, or immediate termination of service. Items must be properly packaged, labeled, and (where applicable) sealed in compliance with OSHA and carrier safety standards.

5. HIPAA & Business Associate Agreement

When transporting items on behalf of a HIPAA-covered entity, OpsMed acts as a Business Associate. A signed Business Associate Agreement (BAA) is required before regular service involving Protected Health Information begins. BAAs are available on request.

6. Payments & billing

Payments are processed by Stripe. Invoices are due upon receipt unless a written agreement specifies other terms. Late payments may be subject to interest and collection fees as permitted by law.

7. Cancellations

Cancellations made after a courier has been dispatched may be billed at the full delivery rate. Recurring route cancellations require advance written notice as set in the service agreement.

8. Liability

OpsMed delivers items with reasonable care consistent with industry practice for medical logistics. Except as required by law or by a signed agreement, OpsMed’s liability for any single shipment is limited to the lesser of the documented replacement cost of the item or USD $100. OpsMed is not liable for indirect, incidental, consequential, or punitive damages, including loss of revenue or loss of patient data not under OpsMed’s control.

9. Indemnification

You agree to indemnify and hold OpsMed harmless from claims arising out of your improper packaging, inaccurate addressing, prohibited items tendered, or your violation of these Terms or applicable law.

10. Website use

You may not attempt to interfere with, reverse engineer, or overload this website, or use it to transmit unlawful content or malware. We may suspend accounts that violate these Terms.

11. Intellectual property

The OpsMed name, logo, and website content are owned by OpsMed and may not be used without written permission, except as needed to identify OpsMed as your service provider.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws principles. Disputes will be brought in the state or federal courts located in Norfolk, Virginia.

13. Changes

We may update these Terms from time to time. Continued use of the website or services after changes are posted constitutes acceptance.
